Free Trial Access For Using The Code Of Talent Platform

 By creating an account for using our Free Trial program, you expressly and unequivocally consent to the conclusion of a contractual agreement between you and us as per the terms herein stated as well as in accordance with the terms and conditions of the Privacy Policy.

Your access to the Platform will be activated by clicking on the link received in your email inbox.  In case the username and the password of your email have been stolen or compromised, please notify us immediately.

This Agreement will be terminated at the expiry of the Free Trial period, except for/when:

  • you agreed to receive further marketing communications from us, case in which we will continue to process your personal data:
  • you accepted to continue the use of our Platform as a Client (and not as a free trial user).

This Agreement is governed and interpreted according to the Romanian law. Any dispute over the use of the Platform and / or the Agreement will be settled amicably first. If the parties do not reach agreement on the dispute, it will be settled definitively by the competent Romanian court

OUR SERVICES AND LIMITATION OF LIABILITY

 We make available the Platform and the Services on an “AS IS” basis, “WITHOUT WARRANTIES”

You expressly acknowledge and agree:

  • to use our Services which include the services of our third-party providers;
  • that the documents you upload in the Platform will be processed by these third-party technology services referred above;
  • to comply with any terms and conditions of our third-party providers;
  • that our Services are designed to be provided exclusively to individuals who are at least 18 years old and you expressly confirm through the acceptance of this Agreement that you fulfill this condition.

You expressly agree that you are solely responsible for:

  • the content you upload within the Platform;
  • the accuracy, the conformity with the copyright rules, the lawfulness or the decency of the information uploaded in the Platform or which can be found on the links (uploaded by you) towards other websites outside the Platform.
  • the manner in which you understand and you will make use of the content generated to you (the output) through the use of Services.
  • the actions undertaken by you as a result of accessing the content of the Platform or of the Services.

You also expressly agree that the documents which are uploaded by you in the Platform will be deleted within 24 hours automatically.

You undertake to defend, indemnify, and hold harmless us, our affiliates and our licensors, from and against any claims, damages, losses, liabilities, costs, and expenses arising out of or relating to any claims concerning: (a) the use of the Services; (b) breach of this Agreement or violation of applicable law; (c) the content uploaded and the content generated (output) to you through the use of the Services or (d) your use of any such content (either uploaded or generated); or (e) a dispute with any third-party provider, or (f) a dispute with any data subject.

Code of Talent is not liable for any output generated through the use of the Services, including the output generated by tech service – generative AI, or for any interruptions of the running of the Platform in order to update it, to keep it to an optimal state of functioning, for the lack of internet performance or for other situations in which the Platform cannot be accessed due to technical errors which are not under the control of Code of Talent. Code of Talent is not liable for any damage, direct or indirect, special, incidental which results from the use or the inability of using the Platform.

 INTELLECTUAL PROPERTY RIGHTS

 All Intellectual Property Rights (including, without limitation, copyright, know how, trademarks, other industrial property rights) regarding the Platform (including without limitation any modifications, additions, revisions and / or derivatives thereof) belong to Code of Talent. You will be granted only a non-exclusive and non-transferable right of use of the Platform during the Free Trial period, for the exclusive purpose of accessing its features.

You are not allowed to:

(i) copy, frame, replicate or mirror any part or content of the Services;

(ii) reverse engineer the Services or any part thereof;

(iii) gain or attempt to gain unauthorized access to the Services or their related systems or networks;

(iv) use the Services to build a competitive product or service to the Services.

DATA PROTECTION 

We undertake to comply with the provisions of Regulation (EU) no. 2016/679 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Regulation on data protection) (“Regulation no. 2016/679”).

The obligations of Code of Talent and your rights for the protection of your personal data are described in the Privacy Policy.

CODE OF TALENT Platform is a software platform developed and administrated by Code of Talent S.R.L, a Romanian private legal entity, headquartered in Balotesti, no. 1C19 Ficusului Street, Ilfov, registered in the Trade Register under no. J23/3797/2018, with the unique registration code RO39735784 (“Code of Talent”), consisting of a software allowing the users the ability to design, deliver and go through a gamified online microlearning experience, solve specific learning tasks, receive feedback and interact with colleagues and the trainer involved in the program.

“User”, “you” or “your” – means you, as a user of the Services;

“We” or “Us” – means Code of Talent, as defined above.
